Legal foundation

What is extradition?

Extradition is the formal surrender of an individual by one state to another for prosecution or sentence execution. Decisions are made strictly by courts, not police: arrest on an international notice does not mean surrender is inevitable.

In Spain, the procedure is governed by Ley 4/1985 de Extradición Pasiva. Surrender is not automatic: it requires reciprocity, the act must also be an offense under Spanish law (dual criminality) punishable by at least one year of imprisonment or a remaining sentence of at least four months. The law prohibits extradition for political offenses, double jeopardy, and generally for Spanish nationals. These statutory filters form the core grounds for defense.

Cases are adjudicated by the Audiencia Nacional in Madrid. The outcome is often determined within the critical first 72 hours during the bail and remand hearing.

Stages of an extradition case

01

Hearing on precautionary measures

The first 72 hours after arrest. The goal is to avoid pre-trial custody.

02

Case review and preparation for the main hearing

Analysis of the request file, gathering evidence and expert opinions, working with lawyers in the requesting country.

03

Court hearing

Examination of evidence, oral argument and the court’s final decision to surrender or refuse.

We step in at any stage — including before an arrest, when you only suspect that extradition or a wanted notice may be coming.
